ABSTRACT
In criminal cases, eyewitness testimony is often presented as evidence and may be pivotal in establishing a defendant's guilt or innocence. There are several elements that might affect the reliability of an eyewitness's account of a crime, and the link between the two is complicated. There are several cases of wrongfully convicted people who were convicted based on false or misleading testimony provided by eyewitnesses. Evidence from studies shows that stress, leading questions, and the passage of time may all have an impact on the credibility of a witness's testimony. In the case of a witness who sees a weapon during the commission of a crime, it's possible that their attention may drift away from the criminal's face and onto the weapon. There is also the possibility of false identifications occurring as a result of police or other authority people subtly suggesting things to witnesses.
