Reimagining Justice: Community Service As An Alternative Punishment For Minor Offenses Under Bns 2023

ABSTRACT


In recent years, there has been a growing recognition of the need to reform criminal justice systems to better balance punitive measures with rehabilitative goals. Within this context, community service emerges as a compelling alternative to traditional incarceration for minor offenses, particularly under the newly implemented Bharatiya Nyaya Sanhita (BNS) 2023 framework. This article critically examines the role of community service as an alternative form of punishment, focusing on its potential to foster both rehabilitation and restorative justice. By avoiding the adverse effects of imprisonment, community service allows offenders to make positive contributions to society, transforming their punishment into an opportunity for growth and redemption.


The BNS 2023 outlines specific legal provisions and guidelines for community service orders, which are analysed in detail to understand their application and efficacy. This paper explores the procedural steps established by law, highlighting how these measures can be effectively implemented to ensure compliance and meaningful engagement from offenders.


Furthermore, the article delves into the advantages and challenges of community service as an alternative punishment, considering both theoretical perspectives and real-world applications. It presents comparative analyses with other jurisdictions and offers practical suggestions to enhance the existing legal framework, aiming to improve the integration of community service within the criminal justice system.


Ultimately, this study underscores the potential of community service to serve as a rehabilitative tool that aligns with contemporary justice objectives. The article concludes with targeted recommendations for policymakers and legal practitioners, emphasizing the importance of optimizing community service implementation to ensure that it serves the dual purpose of promoting justice and advancing societal welfare. By doing so, community service can play a crucial role in reimagining justice and building a more humane and effective response to minor offenses.
