Prospects And Concerns Of Uniform Civil Code In India

ABSTRACT

This article examines the Uniform Civil Code in India, concentrating on its significance, prospects, and concerns. Uniform Civil Code seeks to establish a set of civil laws applicable to all citizens, regardless of their religious beliefs, to ensure equality and justice. The study combines legal analysis, sociocultural perspectives, and empirical data in a multidisciplinary approach. The research uses secondary sources to investigate the historical context of personal laws and the constitutional framework that anticipates the Uniform Civil Code. It examines pertinent Constitutional provisions, particularly Article 44, which mandates the establishment of a Uniform Civil Code. The article examines the debates and controversies surrounding the Uniform Civil Code from the viewpoints of various religious communities, academics, and stakeholders. It examines judicial decisions and legislative initiatives related to the implementation of the Uniform Civil Code, shedding light on the obstacles encountered and the factors influencing its progress. In addition, the study examines the Uniform Civil Code's effect on women's rights, gender equality, and social justice. It investigates how the Uniform Civil Code can combat prevalent discriminatory practices in personal laws and contribute to a more equitable society. In addition, the dissertation investigates potential conflicts between religious liberty and the Uniform Civil Code by analysing the concerns raised by various religious communities. Through empirical research methods such as surveys and interviews, the study collects the perspectives of various segments of society. It examines public opinion, social attitudes, and the preparedness of diverse communities to implement the Uniform Civil Code. This research contributes to the existing literature on the Uniform Civil Code in India by thoroughly analysing its historical, legal, and sociocultural dimensions. The findings illuminate the Uniform Civil Code's complexities, difficulties, and potential advantages. The study provides insights that can help policymakers, legal practitioners, and advocates for social change navigate the path to a more inclusive and equitable legal framework in India.
