Property Rights Of The State And Private Bodies Over Water Sources In India

ABSTRACT

Water is one of the basic needs of humanity. Due to the emerging global crisis, this need has become even more serious. There has always been a raging debate with regard to the ownership of water bodies in India. This paper will mainly focus on understanding and analyzing the property rights of both, the State and private operators over water resources in India. Firstly, this paper will attempt to analyze and discuss the rights that are vested in the State vis-à-vis various water resources in India. The author will then move on to discuss the scope of ownership of water sources by private operators. This paper will also analyze and compare the benefits and drawbacks that come along with privatizing water resources. Lastly, the author will give his opinion and suggest certain reforms that can be brought in the water sector in India.
