ABSTRACT


In India, families are structured in a uniform fashion. Property acts as a central force towards which members of the family gravitate. This paper analyses aspects of family settlement in India. It aims at making the layman understand how his or her rights can be achieved and how the various legal components of registration, stamping, tax evasion engulf in the settlement. One of the peculiar aspects is non indulgence of judiciary in family arrangements. Further, the paper focuses on various judicial pronouncements which highlight this peculiar feature with appropriate instances.
