Pre-Colonial History Of Laws Surrounding Queer Relationships

Introduction

With the honorable supreme court taking cognizance of queer marriage and people looking to include it in the Hindu marriage act, there has been a lot of discussion around whether it is a part of “Hindu culture” and if it should be allowed to coincide with the Hindu marriage. Many people like the united Hindu front2 are in opposition of the same. It is thus of utmost importance that actual history of same sex rights in India, unblemished by the colonial interference is put forth to create well informed opinions.

The whole concept of “un-natural sex” as given in section 377 of the IPC, needs to be rethought with the backdrop of actual Indian culture and history. We here need to separate ourselves from the colonial era rule and create a new system based on values actually belonging to our culture. Thus informing the masses about pre-colonial laws becomes necessary.
