Posthumous Publicity Rights In India: Position In India

ABSTRACT

Celebrity rights or rights held by a celebrity have been in limelight since quite some time now but even then there is no specific legislation that addresses the issues and challenges faced by the celebrities due to misuse of their name or work or even just the breach of their privacy. Even though the judiciary has tried to solve these issues with help of IPR laws and the Constitution in general, the same is not sufficient. The problem is even more amplified when we consider posthumous celebrity rights i.e. the rights that a celebrity possesses with respect to their work after their death. This paper analyses the trend in posthumous celebrity rights in India while referring to a number of cases and application of law in them.
