Polygyny And Feminism: Transgression Of Muslim Women’s Rights In India

ABSTRACT


Polygyny - The prejudiced practice that still persist in this 21st Century. When we usually refer to the institution of marriage, we conceptualize it as a bigamous marriage where the marriage is solemnized between one man and one woman, but the institution of marriage always need not be bigamous. There are a lot of countries which still practice polygynous marriage which is a kind of marriage where one man is allowed to marry multiple women. These kinds of marriages are supposedly violating and discriminating women based solely on their gender, therefore polygyny is not morally accepted by a majority of population all around the world. Polygyny is a variant of polygamy, a general term which refer to marriage with more than one person. Polygamy is dissected into two terms- Polygyny and Polyandry. Polyandry is the practice where a woman is allowed to marry more than one Husband. Evidently the practice of polyandry is not as common as the practice of polygyny. The practice of polygyny violates everything which the feminism today stands for and therefore it is really important to comprehend how both of these concepts collide and what can be the way forward. In this article we will be focusing on Polygyny exclusively, practiced among Muslims in India and how such unfettered practice of Polygyny negatively slams the ideologies of feminism. This article also focuses on how polygyny repeatedly is prejudiced against women and how it transgresses the Muslim women’s rights.
