Personal Laws And The Rights Of Women With Respect To Marriage, Adoption And Inheritance

ABSTRACT


Religion is a susceptible topic in a country like India, where religion is not just a mere classification of people based on what God will they preach or what things they will do. Religion in India is a way of living that people possess and a vital part of their day-to-day lives and the things they do in a day. PERSONAL laws are the laws that govern various religions present in our country like the Hindu Succession Act 2005, Hindu Inheritance Act for the Hindus and the Shariat Application Act, Muslim Women (Protection of Rights and Divorce) Act for the Muslims, but these laws suffer from various LACUNAE even after having several amendments throughout their time being, and those lacunae are mainly concerned to women with respect to Marriages, Divorce and Inheritance. The methodology used in this research provides an analysis of the various personal laws and how the lack of parity is a state of concern for society as this hinders the society that is progressing at a very rapid speed with respect to the RIGHTS of Women. The findings provided in the research gives us an idea as to what measures can be taken or what amendments can be made in order to provide parity between the two genders and provide them with equal rights as this is a state of concern because of the long hand discrimination that the WOMEN have dealt or are dealing with. The study highlights the need for equality between the rights of the two genders regarding their personal laws and how providing EQUAL rights to women with respect to Marriage, Divorce and Adoption will empower and act as a betterment for society as a whole.
