Pay Equity Legislations In India: A Detailed Analysis

ABSTRACT


India is a fast growing economy which desires to attain the economic superpower. But such would remain a dream until and unless the doctrine of equal pay for equal work is fully and efficiently implemented in India. This problem of unequal wages for equal work is a matter of huge concern in India as the disparities with regard to salaries are huge which creates a hurdle in the economic development of the country. In this paper, Author aims at elaborating the true meaning of the doctrine of equal pay and equal work and to understand the constitutional perspective with regard to pay equity legislation. Along with this, an attempt has been made to discuss the legislations which are being passed by the legislature in order to curb the pay gap in India. In this paper, The Author is intended to bring out the factors which are leading towards huge gender pay gap in India. An attempt has been made in order to understand the flaws in the pay equity legislations and the possible solutions that would lead to better implementation of such laws. In order to carry out the research certain case laws, articles and the statistics have been referred to.
