ABSTRACT
The COVID-19 pandemic left the whole world shattered, and India was no exception. It affected each and every aspect of human lives – economically, socially and politically. The government made commendable efforts to curb the spread of COVID-19 and to contain the virus. The same was done by relying on various laws that empower the government to adopt measures to keep the situation under control. The paper examines the laws that helped the government to fight the COVID-19 and suggests the reforms for the same.
The paper consists of four parts. Part I, titled “Introduction,” is a prologue to the paper. Part II, titled “Indian Laws and the Pandemic,” lists and summarizes the relevant laws in India that can be applied during times of pandemic. Part III, titled “Indian Constitutional and Legal Framework Related to Health Emergencies,” explains and analyzes the Constitutional provisions related to health emergencies as well as the provisions under the Epidemic Diseases Act,1897 and Disaster Management Act, 2005. Part IV, titled “Suggestions for Strengthening Laws Related to Health Emergencies”, concludes the paper with suggestions in the form of reforms to be made to the existing laws.
