Palimony In India: Genesis And Recognition Under The Indian Legal Framework

ABSTRACT

The current article seeks to examine and present forth, the genesis and conception of palimony within India and furthermore, analyze the recognition accorded to palimony under the current legal landscape prevalent in India. It commences with a brief introduction to palimony and thereafter, comprehensively describes the origin and progression of palimony in India, through the three marked periods i.e. Ancient, Medieval and British periods, with reference to “live-in relationships” and, associated customary and statutory laws prevalent in each period. This is followed by an examination of the legal recognition conferred on palimony and live-in relationships in the contemporary, post-colonial period. The resultant impacts are discussed in the subsequent section. The article ends with recommendations proposed by the author, aimed at counteracting the observed harms.
