ABSTRACT
Black law dictionary defines plea bargaining as, “the process whereby the accused and the prosecutor in a criminal case work out a mutually satisfactory disposition of the case subject to the Court's approval. It usually involves the accused pleading guilty to a lesser offence or to only one or some of the counts of a multi-count indictment in return for a lighter than that possible for the graver charge. The paper's main highlights are the introduction of plea bargaining in India, as well as its characteristics and comparison with the US model. The study also seeks to depict the Indian legal development of the idea of plea bargaining. The goal of the paper is to stimulate discussion within the legal profession in order to advance plea bargaining in India and lower the ostensibly huge case backlog.
