ABSTRACT
Opinion polls are integral to democratic processes, providing crucial insights into public sentiment and influencing electoral outcomes. This study examines the role and impact of opinion and exit polls within modern electoral systems, focusing on their regulation and the challenges posed by contemporary media. Traditional media regulations aimed to prevent undue influence by restricting poll results close to election day, but the rise of social media has introduced new complexities. Platforms such as Facebook and YouTube facilitate the rapid dissemination of polling information, potentially skewing voter behaviour and challenging existing regulatory frameworks.
The study highlights the need for updated regulations to address these new media dynamics while ensuring electoral integrity. The recent case where misleading exit polls reportedly impacted stock markets underscores the broader implications of poll information beyond election outcomes. Comparative analysis with other democracies reveals various approaches to poll regulation, balancing freedom of expression with electoral fairness. For instance, in the United States, minimal restrictions reflect a commitment to free speech, despite the potential for influencing voter decisions.
The findings suggest that while opinion polls play a vital role in informing voters and enhancing political accountability, their potential to sway behaviour necessitates effective regulation. Such regulation should involve robust legal frameworks, vigilant oversight by electoral authorities, and judicial enforcement to mitigate risks of bias and ensure fair elections. Ultimately, a nuanced regulatory approach that accommodates modern media's influence while preserving democratic values is essential for maintaining a transparent and accountable electoral system.
