Ombudsman In India And Its Enactment In Tamil Nadu

ABSTRACT

Ombudsman is a Sweden concept which was created to sought out the grievances of the citizens against the administration. The power which was vested to focus on people and parliamentary attention upon citizens grievances. The officer who has a duty to investigate the grievances of citizens against the government. It has its root cause in almost all the countries. Likewise, it plays an important role in India in the name of Lokpal. The complaints or allegation of people are handled by experienced people who are members of department concerned. In India the two-tier system was followed. The commission which was created at the centre level is called Lokpal and in state level it was called as lokayukta. Some of the states which adopted Lokayukta is Uttar Pradesh, Karnataka, Andhra Pradesh, Maharashtra, Orissa, Rajasthan, Gujarat, Kerala and Tamil Nadu. The jurisdictions which were dealt by the Lokayukta are ministers, public servants and officers. In Karnataka the jurisdiction also includes chief minister. In Maharashtra, Bihar, Uttar Pradesh and Rajasthan the jurisdiction of Lokayukta does not include ex ministers and ex secretaries of administration. In this article the concept of Lokpal and Lokayukta and its function and origin were dealt. The Lokayukta was created in Tamil Nadu only after it gets a notice from the supreme court which mandates all states to constitute Lokayukta within a year. The legislative assembly of Tamil Nadu has constituted Lokayukta in the sixty-ninth year of republic of India. Section 63 of the Lokpal and Lokayukta Act mandates every state to constitute Lokayukta within a year. There was no such intention to constitute Lokayukta in Tamil Nadu until July 10. Only after the notice given by supreme court, Lokayukta was constituted. It was built in Tamil Nadu without much discussion and zero amendments were made. We can also see the defects in Tamil Nadu Lokayukta bill, 2018.
