Of Leviathans And The Law Of The Sea: An Indo- Pacific Perspective

ABSTRACT


The modern United Nations Convention on the Law of the Sea (UNCLOS), heavily influenced by the works of Grotius, is one of the oldest and most developed areas of public international law. It provides a legal framework for the governance of international oceans and marine resources and promotes a spirit of mutual understanding and cooperation on all maritime disputes.1 This paper aims to analyze the effectiveness of the UNCLOS dispute resolution mechanisms specifically in the Indo-Pacific region by comparing a successful outcome - here, the Bangladesh-India Maritime Boundary Dispute - to the unsuccessful and ongoing Japan-China Senkaku/Diaoyu Islands Dispute. Contrasting and analyzing these cases may facilitate the formulation of informed insights and conclusions regarding potential future actions, ultimately contributing to the preservation of peace on the world's oceans.
