Need Of Reconstruction Or Revision Of Civil Procedure Code: Critical Analysis

ABSTRACT


The Civil Procedure Code (CPC) in India plays crucial role in the administration of civil justice. However, the current CPC faces challenges such as delays, high litigation costs, and complex procedures. This research paper critically analyzes the need for reconstructing or revising the CPC. The study employs comprehensive literature review and comparative analysis of civil procedure in other countries. The findings reveal that streamlining procedures reducing delays simplifying fee structures and encouraging alternative dispute resolution mechanisms are essential for improving the efficiency of the CPC. The paper proposes recommendations for amending specific provisions implementing technology and promoting ADR. The study highlights the importance of reforming the CPC to ensure access to justice and efficient functioning of Indian legal system. The implications of this research lie in guiding policymakers and legal professionals towards more effective and streamlined civil procedure code.
