Navigating The Legal Waters Of Cohabitation: A Socio-Legal Review Of Live-In Relationships

ABSTRACT

Live-in relationships, also known as cohabitation or common law marriage, have become increasingly prevalent in recent years. This trend has challenged traditional norms and beliefs about marriage and family, and has raised numerous socio-legal issues. This paper aims to provide a socio-legal analysis of live-in relationships in India, examining the various legal dimensions and implications of such relationships. This article explores the social and cultural factors that have contributed to the growth of live-in relationships, the differences between marriage and cohabitation, and the legal status and rights of individuals in such relationships. The paper also examines the challenges and issues associated with live-in relationships, such as property rights, domestic violence, child custody, and social stigma. Finally, the paper offers recommendations for addressing the socio-legal issues associated with live-in relationships, and suggests possible legal reforms that could better protect the rights of individuals in such relationships.
