ABSTRACT
This article aims to initiate a serious debate on the right to privacy and data protection of citizens in India in the year 2023. In this digital world, people depend on smartphones which leads to easy accessibility of their data. Although the right to Privacy is not explicitly mentioned in Article 21 of the Indian Constitution, the judiciary has evolved it in their judicial pronouncement which is considered the incorporeal property of individuals. Data protection in today's world is the primary concern of every individual. Data protection and privacy has been dealt with in the Digital Data Protection Act 2023. Data protection may include one's health information in corporate properties, business proposals, and other sensitive data. The entire world has shifted toward online activities after the coronavirus pandemic which leads to the easy availability of data.
