Navigating Cyber Challenges In India: Legal And Administrative Hurdles In State-Level Cyber Law Implementation

Shreya Rani, Amity Law School, Amity University Patna

ABSTRACT

India, one of the largest and most connected countries in the world, has passed comprehensive national legislation to tackle cybercrime, which is a serious concern in the digital world.

The effectiveness of measures to prevent cybercrime can be hampered by lack of public awareness, which is a key factor restricting people from reporting cybercrimes, ineffectiveness of investigative agencies and various other legal and administrative hurdles. The article suggests a more coordinated strategy across Indian states, spending money on law enforcement personnel's training and development and pushing public awareness campaigns to improve cybercrime reporting and compliance in order to overcome these legal and administrative hurdles, with the title ‘Navigating Cyber Challenges in Indian State-Level Cyber Law Implementation: Impact on Cybercrime Prevention and Investigation’.

However, there are substantial difficulties in putting these rules into action and enforcing them at the state level. The study concludes that although Indian cyber laws are specific, their application across different states is uneven because of resource distribution, disparate levels of competence, and increasing cyber threats. As cybercrimes grow quickly, it is difficult for law enforcement authorities to keep current with technological developments and legislative changes. Access to digital evidence by law enforcement while maintaining individual privacy is a tricky and divisive balance.
