Mining Rights In Outer Space: To Be Or Not To Be?

ABSTRACT


The depletion of the Earth's natural resources has prompted private and state players alike to explore viable alternate sources of energy. Breakthroughs in the modern world are setting the stage for commercial mining of the lunar surface, asteroids, and other celestial bodies. The objective of this study is to examine the legal aspects of mining in outer space and to identify, interpret, and elaborate on existing rights and legal frameworks at the international and domestic levels. The aim is to analyze the combined impact of technological advancements and domestic laws passed by the United States of America and Luxembourg on the world community in the backdrop of the Outer Space Treaty and the Moon Agreement.
