Mesne Profits Under The Code Of Civil Procedure, 1908

Introduction


The essential premise on which the Code of Civil Procedure, 1908 is based is ubi jus ibi remedium, which means "where there is a right, there is a remedy." The notion of mesne profits arose from this premise since it is the law of nature to grant the right to compensation where a legal right has been infringed or breached. Before getting into the notion of mesne profit, it's important to define the words " and "p ossession." While the former is a man's sole collective right to possess, enjoy, transfer, and destroy property that he owns, the latter serves as prima facie proof of the former.The essential premise on which the Code of Civil Procedure, 1908 is based is ubi jus ibi remedium, which means "where there is a right, there is a remedy."
