Mental Health Insurance In India: Genesis, Development & Limitations

Saket Sharan, Chanakya National Law University

ABSTRACT

Mental health insurance in India is a relatively new concept that has emerged in response to the growing burden of mental illness in the country. The genesis of mental health insurance can be traced back to the Mental Healthcare Act of 2017, which recognized the right to access mental healthcare as a fundamental right.

Since then, several insurance companies have started offering mental health coverage as a part of their health insurance plans. This has led to the development of specialized mental health insurance products that provide coverage for a range of mental health conditions, including depression, anxiety, and schizophrenia.

Despite these positive developments, mental health insurance in India faces several limitations. One of the biggest limitations is the lack of awareness and understanding of mental illness among the general public. This often results in a reluctance to seek help for mental health problems, and a lack of demand for mental health insurance.

Another limitation is the limited coverage provided by most mental health insurance plans. Many plans have restrictions on the types of mental health conditions that are covered, as well as the amount of coverage that is provided. This can make it difficult for people with mental illness to access the care and support they need.

Overall, while mental health insurance in India is a positive development, there is still a long way to go in terms of improving awareness and access to mental healthcare
