CHAPTER 1: INTRODUCTION

In a typical social structure, the hegemony of dominant values combined with significant authority is the deadliest combination. In a nation with open borders and a flimsy social structure that crumbles when put to the test by constitutionalism, these ideals restrict people's freedom of choice. The inability of an individual who is carrying life inside of her to choose to have a medical abortion has become one of the most frustrating issues for feminists in recent years, and it appears unsolvable. The MTPP Act of 1971, which was intended to make medical treatment more accessible, has placed restrictions on medical abortion, which is the worst thing about it. In order to determine if abortion is now a right or a privilege, it's crucial to examine the MTP (Amendment) Act of 2021. We need to ascertain if the right to procreation is preserved in accordance with the letter and spirit of the Const.. Is the patriarchal structure of society maintained by ignoring the risks faced by rape survivors and women who become pregnant unintentionally? Do just women have to take care of the new life??

The laws about abortion have always been changed to fit the historical and social contexts in which they are used. Even though these standards have different forms, goals, and directions, they all try to meet social needs while ignoring women's right to choose their sexuality, fertility, and reproduction.”
