Medical Negligence Under The Ambit Of The Consumer Protect Act, 1986 (COPRA)

ABSTRACT


The medical occupation is considered as the most caring and the oldest professions. It is the duty of state to protect the basic right of “Right to Life” which is surefire by Art. 21 of the Constitution. Providing citizens with best medical service is another duty of state. The Consumer Protection Act, 1989 (COPRA) was enacted for the purpose of providing customers/patients with best possible treatment with relation of trust. The main paper will be analyzing ‘The Consumer Protection Act,1986 and medical negligence’. The researcher shall be explaining term such as- consumer, service, negligence etc. All of the above shall be done via the help of various case laws for providing a better understanding of the concept.
