ABSTRACT


A major issue in the world of healthcare is medical carelessness, sometimes known as medical malpractice or medical mistakes. This study thoroughly examines the many facets of medical negligence, focusing on how it affects patient safety and public health. It explores the accountability assumed by healthcare professionals, looks at potential hotspots for carelessness, and emphasises potential legal repercussions. The paper explores the legal environment of medical negligence in India and conducts comparative assessments of healthcare systems throughout the globe to provide insights. The function of the court is clarified through judicial assessments of well-known instances, and the fundamental elements of medical negligence are looked at. It is emphasised that governments and healthcare organisations have a crucial role in maintaining patient safety as challenges and reform suggestions for the law are examined. A safer and more responsible healthcare environment is the goal of this study.
