ABSTRACT
Like developed countries, Bangladesh has inserted the provisions for mediation long ago, though the provisions are not comprehensive. Till today, there's no effective institution for overseeing the issues relating to mediation, or for training up judicial officers with mediation skills. Due to these facts, litigating parties are dependent on lawyers who suggest formal court systems, not resolving disputes through mediation. As a result, mediation cannot play any effective role in reducing backlog of cases, but it will surely play the desired role if mediation can be made popular among parties, and trained mediators can play the perfect role.
