ABSTRACT
Today, it is necessary to view every citizen of a democratic country as an equal state. It doesn’t matter whether he is a man or woman, all communities are equal in the eyes of law. They have the right to be represented in front of the world. But some instances don’t let this happen. The higher number of these instances is with the women community. The women community is the one that suffers most among the other communities. One of the instances is domestic violence. This comprises cruelty by husband, adultery, dowry deaths, and the most heinous offense, Rape. However, rape cases in today's world are on the peaks even when there are laws prohibiting rapes. But this paper focus on marital rape. The most heinous crime destroys the holiest and the pure bond of marriage. Some countries don’t recognize this as even a crime. Therefore, this paper tries to explain what is marital rape and also, highlights the legal status of marital rape, mostly in India, and provides a glance at the international perspective.
