Lifting Of The Corporate Veil

ABSTRACT


Through this paper, the author examines the Doctrine of Lifting of Corporate Veil or Piercing of Corporate Veil. The doctrine arising from the Companies Act, 2013, removes the distinction between the legal identity of the company and the owners of the companies. The paper aims to examine the need to pierce the corporate veil and the situations where the courts considered piercing the veil as the way to conclude a case. Additionally, it aims to discuss the challenges the Doctrine of Lifting of Corporate Veil faces in its application. In short, this paper seeks to establish the requirement of the Doctrine of Lifting of Corporate Veil in India and the challenges the doctrine faces in its practical application.
