Life, Death, And Dignity: Euthanasia In India And The United States

ABSTRACT


This paper will discuss about the legal aspects of passive euthanasia in various states of the USA and the Republic of India. Furthermore, the evolution of the legislations in different states will be discussed along with the role of judiciary in legalising or criminalising the act of “Physician Assisted Suicide”. In context of India, the active role of Supreme Court will be discussed in cases which have no parliamentary or state legislations to look up to. In the end a comparison is drawn between the two countries and the need for relevant legislations is discussed.
