LGBT Acceptance And Adoption In India

Dhairya Mamtora, UWSL (Karnavati University)

Introduction

This article revolves around the periphery of the below mentioned three things which are to be considered seriously in this time period,

  1. Are homosexual couples not capable to raise a child?

  2. Are homosexual couples not eligible to be accepted like heterosexual couples?

  3. Seeing the population and the poverty of India can an orphan cannot be adopted by homosexuals is justifiable?

These types of questions are already blocking the mind of people after seeing India's situation on homosexuality and the contribution of Legislation towards it. On September 6th, 2018 supreme court took an outstanding decision that decriminalises same-sex marriage in the case of Navtej Singh Johar and Ors. vs. Union of India (UOI) and Ors. (06.09.2018 - SC), but the ruling applied to the “personal private domain of individuals akin to the right to privacy and cannot include a public right in the nature of recognition of same-sex marriage and thereby legitimizing a particular human conduct,” it said in response to a court notice to a plea by LGBT activists and couples who sought recognition of same-sex marriages.
