Lesson From The Pandemic: Should Right To Basic Health Amenities Made A Fundamental Right?

ABSTRACT


This paper focuses on the Right to basic health amenities as a fundamental right in relation to the current pandemic situation. Health is one of the basic human rights that underpins the practise of all other human rights and is necessary for living a dignified life. Health-care system is as important as a just and democratic political structure in any nation. In the COVID-19 pandemic, common freedoms analysis has for the most part centred around limitations of individual freedoms to shield general wellbeing, however it is basic to consider the more extensive meaning of acknowledging basic liberties to work on general wellbeing in the COVID-19 reaction. The study also points out that legal practise and case law can resolve current concerns. The Supreme Court have acknowledged right to health as a basic right and have established the State obligation to provide medical services through their decisions.
