Legality Of Clickwrap Agreements

ABSTRACT

Clickwrap or clickthrough agreements are the once which are digitally presented agreements before accessing any applications or any online content. These agreements usually ask for various permissions to the user before accessing or using a particular app. A note is at its dispense when any online site or application is downloaded which summarizes all privacy policies, copyright policies, other terms and conditions. The most known phrase in such agreements is “I agree to terms and conditions” and thereby the response of the user is recorded. Although these agreements are smooth and prompt but they are hard to find during the agreement process. These agreements are lengthy and are executed on daily basis by business for accessing social networking sites, opening bank accounts, for using various software’s and not just businesses but are also used by kids, elderly and ordinary people for gaming, research work, for acquiring various skills, etc.

This paper reflects different elements of clickwrap agreements and its legality along with the extent of user’s safety. This paper expands its horizon mainly in the topic of e-contracts and its implications. It’s important to understand that with increasing digitalization there is also increase in implementation of e-contracts.
