Legal Status Of Children Born Out Of Live-In Relationships

ABSTRACT


In the lieu of rise in Live-in relationship in India, it becomes important to understand the right and legislation regarding this new social concept. If in a live-in relationship, where two consenting adults are living together as husband and wife, and if consequent to the sexual relations, an offspring is born, he/she/they may be looked at differently as compared to the other children given that this is still a new social concept (especially in India). The society might look at them through a different lens. This article analyses the rights of children born from such relationships. It also tries to answer the question, whether there is a need for a special legislation for these children. The article is divided into four parts, where we discuss the legal scenario on legitimacy, preservation of children, right to property and custody of the child. While there are many more legal questions around the rights of these children, this article only focuses on these four issues as they are very basic to answer other complex questions.
