Legal Frameworks Vís Á Vís Environmental Protection

ABSTRACT

In India there are numerous legal provisions providing for the protection of Environment from the humans. In today’s scenario we can see that the problem of environmental degradation is at it’s peak. A number of constitutional provisions have been provided under Indian Constitution for the protection of Environment whereas except these constitutional provisions there are various legislative Acts also, for the protection and enhancement of Environment. These Acts includes: Water (Prevention and Control of Pollution) Act, 1974; Air (Prevention and Control of Pollution) Act, 1981; Environment (Protection) Act, 1986 and also the establishment of NGT (National Green Tribunal) in 2010. Except these there are various provisions mentioned under Indian Penal Code, 1860 which focuses on the penalties and punishments for the degradation of environment.

In this Research Paper I’ve focused on the loopholes in the Indian provisions or the implementation system that leads to the Environmental Pollution, the various types of Environmental Crimes and some suggestions from my point of view.
