ABSTRACT
Since World War II due to Globalization and Rapid economic development there has been a tremendous increase in trade through the waterways. It is the main transport mode for Global trade. Around 90% of trade in the world happens through the waterways, especially the trade of oils. Oil spills have an extremely detrimental effect on the environment as well as the marine ecology. It is considered to be one of the worst ecological disasters. It is not only one or two states' concern but it is a global problem because it is extremely difficult to clear the oil from the sea as there is a use of numerous techniques depending upon the type of oil, the temperature of the sea, the area it took place etc. However an oil spill cannot be completely cleaned up. Only a certain percentage of oil can be cleared. It takes almost 15 years for a small oil spill to completely disappear.
In this paper, the author would detail the effects of oil spillage, international laws with respect to the spillage and Indian laws regarding the same. The author would also discuss if there is an adequate implementation of the laws by the Indian authorities and if there is a deterrent effect of the present spillage laws.
