Legal Discourse On Draft Industrial Relations Code 2019

Vaibhav Kartikeya Agrawal, Advocate

Introduction

The draft Industrial Relations Code 2019 is amalgamation of the Industrial Disputes Act 1947, the Industrial Relations (Standing Orders) and the Trade Unions Act. It has defined certain new terms and also amended existing provisions of the existing aforementioned Acts. This paper endeavours to contemplate various provisions of the draft Industrial Relations Code 20109 in terms of clarity in practice of the new terms used in the draft Code and the significance of these terms. It also endeavours to provide suggestions in relation to the legal terminology used in drafting of the Code of 2019 and in order to make the Code more oriented towards its object and towards the Preamble to the Constitution of India.
