ABSTRACT

Most maritime laws deal with transporting goods at sea, regulations on the protection and maintenance of ships at sea, registration and damage to vessels and Ships, marine insurance, etc. also known as admiralty law, which is private in nature. Its public law correspondent is known as the Law of the Sea. Most maritime laws deal with transporting goods at sea, regulations on the protection and maintenance of ships at sea, registration and damage to ships or vessels, marine insurance, etc. The global shipping industry has evolved from simple maritime trade to a complex network of highways and waterways. It's about delivering billions of dollars worth of consumer goods to customers nationwide and around the world. The Maritime Industry Foundation reports that around 1.2 million people are employed in the industry. This is great news for our economy, but it also means that there are 1.2 million opportunities for workers to get injured on the job. In the era of globalized trade and commerce, it is necessary to amend various archaic English laws governing maritime relations and claims in India, and this is led to the introduction of a new law, namely the Admiralty Act 2017 (Maritime Claims Jurisdiction and Settlement Act). Act of the Indian Parliament, effective from 1st April 2018. The primary focus of this research report is to comprehend the legal concept of Maritime law also called admiralty law with the help of secondary sources. Thereafter an attempt has been made to study the challenges and problems like Jurisdiction Admiralty & Specific, Maritime Liens, Possessory Liens, Necessaries, A Maritime Claim, Claims Relating To Cargo, Effect Of Arbitration Clause On Arrest, Security For Costs And Damages, Wrongful Arrest, Admiralty Rules, Pleadings, Writ Of Summons, Ship Arrest, etc. Lastly, a brief relevant case study will be done to better understand the topic.
