ABSTRACT

Layoffs are the temporary suspension of employees whose name is present in the muster roll. The laws dealing with layoffs in India are unambiguous and easy to understand. The Industrial Disputes Act, of 1947 provides remedies for all the problems an employee faces and also permits the employer to lay off employees once certain conditions are fulfilled. However, in recent times looking at layoffs happening all over the globe, we often see layoffs conflicting with the rights of the citizens. Layoffs by nature are not unethical. But the way it is implemented can be unethical. In this article, we have covered the reasons for layoffs, the compensation to be provided, and the remedies available to the people affected by layoffs in detail.
