Laws Regarding Sexual Offences And Their Oppressive Nature Toward Men In India

ABSTRACT

Men suffer from sexual violence and false rape charges which are becoming very common in today’s world. In Indian Criminal Law there is no gender neutrality in laws, as a result, there has been a surge in the suicidal rates among the male members of the society because of false and derogatory charges imposed upon them. In today’s world women can file rape charges against men even online and it has been made a matter of utmost importance that police officers should take cognizance of this matters. Even, if we consider laws that tackle stalking it can be found that there is no protection which is given to men under the Indian Criminal law. It is a serious matter of concern that sexual intercourse with the promise of marriage and failing to fulfill the promise is considered a serious offense and considered as rape, however, marital rape is not recognized as an offense in the Indian Criminal Law. In this paper, I have discussed how laws regarding sexual offenses are made and their oppressive nature toward men in our society, to support my paper I have also discussed certain case studies relating to false charges of rape by women against men in our society. So, it is to be noted that gender neutrality in laws should be introduced in the Indian Criminal Law scenario as soon as possible.
