Key Ingredients Of A Fair Hearing: Why Should They Be Followed?

ABSTRACT

The rule of fair hearing is not expressly followed by the Administrative authorities in our country since there is no express condition of it to be followed. If the rule of fair hearing is not followed by the authorities that simply means the principles of natural justice is violated to the affected party. The administrative authorities should be more focused on establishing the rule of fair hearing and must ensure that all Administrative proceedings include the necessary ingredients of fair hearing in order to give the affected person a fair chance to express his defense and make sure his opportunity to be heard is not denied.

This article covers all the ingredients of Fair hearing. This paper also throws light upon the process of these ingredients and their purpose which are also assisted by supporting landmark case law judgements.
