Introduction


Marriage is an institution that not only binds two individuals together but their families too.But even such an institution comes with its own issues and disputes, some trivial and some major issues that forces the parties to turn up to the courts of the country for resolution. Matters can get so grave that at times the families of the parties are also dragged to the courts.Sometimes such is the situation that families are forced to undergo litigation and even if acquitted, scars inflicted are so grave that it stays a lifetime. In the case of Kahkashan Kausar v. State of Bihar, the Hon’ble Supreme Court of India reiterated that matrimonial disputes are on a rise in the country and it is often seen that sections such as 498A are being misused and inflicted to settle personal vendetta against her husband and his family members.
