“Justice Delayed Is Justice Denied": Pendency In Court Cases In India: A Comprehensive Analysis

ABSTRACT:

Addressing the issue of pendency in court cases in India is imperative to maintain public trust, uphold the rule of law, and ensure timely justice delivery. A multifaceted approach involving resource allocation, procedural reforms, public awareness, and a focus on streamlined appeals is crucial to alleviate this complex challenge. It is essential to continue evolving and innovating the Indian judicial system to adapt to the growing population and increasing caseload. The article also highlights the steps that have been taken to address the challenge of pendency. These include the appointment of more judges, the integration of technology to streamline court processes, the promotion of alternative dispute resolution (ADR) mechanisms, and the establishment of fast-track courts. While these measures are steps in the right direction, they do not come without challenges and limitations, which are discussed in detail. The issue of pendency in court cases is a multifaceted challenge that poses significant hurdles to the Indian judicial system. It is not only essential to address this issue to ensure timely and efficient justice delivery but also to reinforce the faith of the people in the judiciary, which is a cornerstone of a democratic and just society. As we move forward in addressing this complex challenge, a holistic approach that encompasses resource allocation, procedural reforms, public awareness, and streamlined appeals is crucial to alleviate the burden and uphold the principles of justice and the rule of law in India. The issue of pendency in court cases is a significant challenge facing the Indian judicial system. With a population of over 1.3 billion people and a complex legal framework, Indian courts often grapple with an overwhelming backlog of cases. This article delves into the causes, consequences, and potential solutions to the problem of pendency in court cases in India, providing a detailed analysis of the issue.
