Jurisprudence View On Victim Compensation

ABSTRACT

Victims are entitled to compensation for any harm they have endured as a result of the crime. The right to retaliation, which is the obligation of the State in a society where the Rule of Law applies, is separate from and distinct from this right. If the state does not uphold this duty, it must nonetheless establish a system to guarantee that the victim's claim to damages for his injuries is not rejected. As a result, in every aspect of the fight against crime, the interests and rights of crime victims should come first. One distinctive method of victim rights is victim recompense. In this paper deals with the definition of victim Compensation, and its nature, along with concept of victimology under this subject, role of judiciary in India, and the emergence of principles in state, including constitutional provisions and related Schemes.
