Jurisdictional Challenges In Cyber Crime Prosecution

ABSTRACT


In the digital age, cybercrime presents significant jurisdictional challenges due to its borderless nature. Unlike traditional crimes confined to physical locations, cybercrimes occur across multiple jurisdictions simultaneously, exploiting the interconnectedness of the Internet. This paper explores the complexities of prosecuting cybercrime, examining issues of jurisdictional overlap, legal frameworks such as the Indian Penal Code (now Bharatiya Nyaya Sanhita, 2023), the Information Technology Act, 2000, and international legal principles. Emphasis is laid on how different nations approach jurisdiction, with comparative references to U.S. jurisprudence and the emerging need for a coordinated global response.
