Judicial Review - A Pivot To Democracy

ABSTRACT

The ultimate authority of the judiciary to examine and assess the legality of a legislation or an order is referred to as "judicial review." We follow the rule of law in India, which means that the constitution is the highest law of the state and that any law that conflicts with it is invalid. When a court determines that a statute, executive order, or other official action violates the written constitution, it has the authority to declare it to be unconstitutional and void. It is the authority used by a nation's courts to check whether the legislative, executive, and administrative branches of government are acting in accordance with the nation's Constitution. The paper covers the meaning of Judicial Review, Concept, Importance, Characteristics, Scope, Procedure and relevant case law for better understanding.
