Issues In Criminal Law: The Menace Of Overcriminalization And Laws Against Begging In India

ABSTRACT

The Bombay (Prevention of Begging) Act 1959 (BPBA) is a law which has been adopted and used to derive similar laws across the nation in order to criminalize acts of begging. This law defines begging in extremely broad terms and sections within this act seem to be targeted specifically toward the urban poor. Unfortunately, visible poverty in urban areas has not meshed well with the idea of an ‘Incredible India’ where our economy is on an upward trend along with jobs and opportunities. This visibility is something to be hidden and not solved. This paper undertakes a comprehensive analysis of the various laws and case laws relating to begging and their effects on society within India.
