ABSTRACT

The globalization of commerce has witnessed an increase in cross-border trade and transactions, resulting in an increased risk of trademark infringements across different jurisdictions. This paper aims to provide an overview of the legal framework pertaining to cross-border trademark infringements in India. In India, the trademarks are predominantly governed by the Trade Marks Act of 1999, which is in adherence to the principles of territoriality, granting exclusive rights to trademark owners within the country. However, with the advent of e-commerce and the internet, the boundaries of traditional territorial protection have blurred, giving rise to a multitude of challenges related to cross-border trademark infringements.

In this context, this paper delves into the legal remedies available with an emphasis on international registration, to Indian trademark owners facing infringements from foreign entities. Indian courts have taken progressive strides in adopting international principles to safeguard trademark rights across borders. Courts have addressed jurisdictional issues through landmark decisions that clarify the conditions under which foreign entities can be held liable for trademark violations in India. Furthermore, International treaties, particularly the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), have been pivotal in shaping India's approach to cross-border trademark infringements. TRIPS has played a crucial role in harmonising global intellectual property standards and enhancing cooperation among member nations.

In conclusion, the paper deals with the evolving landscape of cross-border trademark infringements in India and the measures taken by the Indian legal system to address these challenges. The recognition of international treaties and harmonisation of laws illustrate India's commitment to protecting intellectual property rights in a globalised business environment. As the dynamics of international trade continue to evolve, it becomes imperative for Indian businesses and stakeholders to stay abreast of the changing legal landscape to combat cross-border trademark infringements effectively.
