Interface Of Competition Law With Other Corporate Legislations In India (Powers And Jurisdiction Of The CCI As Compared To Other Enforcement Authorities)

ABSTRACT
For a successful competition law regime, there ought to be one single regulatory body that is empowered to deal with the aspects of competition in a country holistically. However, in a situation like India's wherein there exist other industry specific-regulators alongside the competition commission of India which is also allowed to deal with competition in their sectors, conflicts are bound to arise. The paper aims to understand the powers of the competition commission and where the Indian legislations draw a line with respect to its interference in other sectors. Entities like SEBI and the IRDA have always conflicted with the competition commission on several occasions, which makes it all the more necessary to establish a mechanism in place to remove this jurisdictional overlap. This paper has further analysed suggestive mechanisms that may be established in India to remove these overlaps and give the commission it's due powers to better regulate competition.
