ABSTRACT

Intention to create legal relation is a very important element to form a contract around the world. This paper focuses on intention in England and India and specifies what and why the intention to create legal relation is different in the two countries. This paper also talks about consideration with respect to intention as it is taken in different perspectives in the two countries. It also states the specific problems as well, where some believe consideration is enough so as to prove intention and others believe that intention has to be proven separately. This paper while dealing with these differences also talks about contractual relations between domestic arrangements and commercial arrangements.

Keywords: contracts, intention, consideration, English law, Indian law, contract law theories.
